BAC and DUI Testing
All states have implied consent laws requiring drivers who are lawfully arrested for a DUI to agree to take a drug or alcohol test if requested by an officer. Generally, the testing will be of the driver’s breath, blood, or urine. The results of these tests are often used by prosecutors to prove DUI charges in court. Also, failing or refusing a test can result in license suspension administratively imposed by the state department of motor vehicles.
