Often times, the non-custodial parent does not like the idea of making payments to his or her former spouse—and questions whether the money they send is really spent for the welfare of their child. Regardless of those feelings, a non-custodial parent is legally obligated to pay child support to the custodial parent for the welfare of their child/ren.

Court-Ordered Child Support In Delaware, child support may either be part of a divorce or separation agreement or may be applied for at a later time after a couple no longer lives together. Child support is only legally enforceable if you have a court order. To get a court order for child support, you can submit an application to the Division of Child Support Enforcement. This government agency can not only help you establish child support, but help you enforce child support orders, establish paternity, modify child support and provide assistance with locating an absent parent.

How Child Support is Calculated To determine the amount of monthly child support owed, the state of Delaware relies on an established formula. The child support formula takes into account each parent’s monthly income and the amount of time each parent spends with the child. A child support order can usually be obtained within three months of submitting your application if the non-custodial parent also lives in Delaware. Establishing a child support order may take up to a year if the non-custodial parent lives in another state.
